ESIC Registration and Compliance Guide for Indian Employers 2026

Complete guide to ESIC registration, contribution rates, monthly ECR filing, and compliance for Indian employers in 2026 — including who must register and common mistakes.

ESIC Registration in India 2026: Complete Guide for Employers

The Employees' State Insurance Corporation (ESIC) scheme provides medical, sickness, maternity, and disability benefits to employees earning up to ₹21,000 per month. As an employer, your obligation under the ESI Act 1948 is to register your establishment, deduct the employee contribution from eligible employees' salaries, add your employer contribution, and remit the total to ESIC by the due date each month.

This guide covers everything you need to know about ESIC compliance in 2026: who must register, contribution rates, the monthly filing process, and what happens when you get it wrong.

Who Must Register Under ESIC

Establishments Covered

The ESI Act applies to factories and establishments employing 10 or more persons. Depending on the state, the threshold may be lower — some states extend coverage to establishments with as few as 10 employees, while others use 20 as the threshold. Once covered, the establishment remains covered even if employee count falls below the threshold.

Factories: Any premises where manufacturing activity is carried out using power, employing 10 or more workers.

Shops and establishments: Covered under the Act if they employ 10 or more persons (threshold varies by state notification).

Construction companies, road transport, hotels, restaurants, cinemas, newspapers, educational institutions, and medical institutions are all covered establishments.

States With Extended Coverage

In states where ESIC has extended its scheme, the threshold may be lower than 10 employees. Check with the ESIC regional office for your state if your employee count is between 5 and 10.

Exemptions

The following are generally not covered: seasonal factories (under specific notifications), establishments in areas where ESIC has not yet been implemented, and employees earning above ₹21,000 per month (these employees are excluded from ESIC even if the establishment is covered).

ESIC Contribution Rates 2026

The contribution rates have been revised over the years. The current rates as of 2026 are:

ContributionRateApplied On
Employer contribution3.25%Employee's gross wages
Employee contribution0.75%Employee's gross wages
Total4.00%Employee's gross wages

Who pays what:

  • Employee deduction: 0.75% of gross wages, deducted from salary
  • Employer contribution: 3.25% of gross wages, paid by the employer as a cost above salary
  • Total remittance to ESIC each month: 4.00% of gross wages for all eligible employees

Reduced rate for new employees: New employees registered with ESIC for the first time pay a reduced employee contribution rate of 0% (nil) for the first 24 months of their insured employment in the first contribution period. Employer contribution at 3.25% continues. Verify current applicability of this provision with ESIC, as it has been amended periodically.

Which Employees Are Eligible

ESIC applies to employees earning up to ₹21,000 gross wages per month. "Gross wages" for ESIC purposes includes basic salary, dearness allowance, city compensatory allowance, house rent allowance, overtime wages, and most other cash allowances — but excludes annual bonus under the Payment of Bonus Act, overtime wages paid under the Factories Act in excess of normal hours (in some interpretations), and reimbursements for expenses actually incurred.

An employee who earns above ₹21,000 in a month because of overtime, but whose regular wages are below ₹21,000, remains covered for ESIC — the overtime pushes the gross above ₹21,000 but does not remove ESIC coverage.

How to Register for ESIC

Step 1: Register on the ESIC Portal

Go to esic.gov.in and register your establishment. You will need:

  • PAN of the company
  • Address proof of the establishment
  • List of employees with their names and dates of joining
  • Bank account details of the establishment
  • Details of the nature of business

The system generates a 17-digit ESIC code number for your establishment. This code is used in all ESIC filings.

Step 2: Generate Temporary IP Numbers

When you register, the system generates a Temporary Insurance Person (TIP) number for each employee. Employees use this temporary number to access ESIC dispensaries and medical facilities until their permanent IP number and ESIC card are issued.

Step 3: Issue ESIC Cards to Employees

Once employee details are registered, ESIC issues an e-Pehchan card to eligible employees. The card carries the employee's IP number and is used to access ESIC medical benefits. Ensure all eligible employees have received their cards.

Monthly ESIC Filing Process

Step 1: Calculate Monthly Wages and Contributions

For each ESIC-eligible employee, calculate:

  • Gross wages for the month (including all cash components, excluding bonus and certain reimbursements)
  • Employee contribution: 0.75% of gross wages (round to nearest rupee)
  • Employer contribution: 3.25% of gross wages (round to nearest rupee)

Step 2: Generate the ECR File

The ESIC Electronic Challan-cum-Return (ECR) file is generated from your payroll software and uploaded to the ESIC portal. The file contains employee-wise contribution details — IP number, name, gross wages, employee contribution, employer contribution — in the format specified by ESIC.

Your HRMS should generate this file automatically after the payroll run. If you are generating it manually, the file format specifications are available on the ESIC employer portal.

Step 3: Upload ECR and Pay Challan

Upload the ECR file on the ESIC employer portal (esic.in). The portal validates the file and generates a challan for the total ESIC contribution amount. Pay the challan through net banking or NEFT. The due date for ESIC payment is the 15th of the following month.

Late payment consequences: Interest is charged at 12% per annum on delayed contributions. Penalties for non-payment can reach 25% of contribution amount for wilful non-compliance. ESIC inspectors can attach and auction property for recovery of dues.

Common ESIC Compliance Errors

Wrong Gross Wage Calculation

The most frequent error is using basic salary instead of gross wages as the ESIC base. ESIC contributions must be calculated on gross wages — basic, HRA, special allowance, conveyance, and most other monthly cash components. Using only basic salary understates the contribution and creates a compliance gap that can be uncovered in an ESIC audit.

Not Updating Wages When Salary Increases

When an employee gets a salary increment, their ESIC contribution must be updated from the next contribution period (there are two contribution periods per year: April–September and October–March). Continuing to deduct ESIC on the old salary is a contribution shortfall.

Missing the ₹21,000 Threshold Boundary

When an employee's salary crosses ₹21,000 during a contribution period, they remain covered for that contribution period and the following one. ESIC coverage does not end at the moment wages cross ₹21,000 — it continues until the end of the next contribution period. An employee who crosses ₹21,000 in May (during the April–September contribution period) remains covered through March of the following year.

Not Registering New Employees Immediately

New employees must be registered on the ESIC portal within 10 days of joining. Late registration means the employee has no ESIC coverage during the gap, which creates a liability for the employer if the employee makes a medical claim during that period.

ECR File Format Errors

The ESIC portal is strict about ECR file format. Column mismatches, missing IP numbers, or wage figures with incorrect decimal places cause file rejection. A rejected ECR file means your contribution is not processed, and the payment challan cannot be generated. If your HRMS is generating ECR files, verify the format against the latest ESIC specifications — the format has been updated periodically.

ESIC Inspections and Audits

ESIC officers have the authority to inspect any covered establishment and examine payroll records, attendance registers, and contribution challans. Common triggers for an ESIC inspection include: an employee complaint, non-filing of returns, discrepancies detected in ECR data, and random compliance audits in high-risk industries.

During an inspection, have available: the establishment registration certificate, all ECR files and payment challans for the past three years, payroll registers showing gross wages for each employee, attendance records, and the list of all employees with their IP numbers and joining dates.

Frequently Asked Questions

Is ESIC contribution calculated on gross salary including HRA?

Yes. HRA is included in gross wages for ESIC calculation. The only components typically excluded are the annual bonus under the Payment of Bonus Act, amounts paid as reimbursement for expenses actually incurred (travel reimbursements with receipts, medical reimbursements with bills), and gratuity payments.

What if an employee is on maternity leave — is ESIC still paid?

An employee on ESI maternity leave receives maternity benefit directly from ESIC, not from the employer. The employer does not pay wages during ESI maternity leave (the ESI scheme covers this), and consequently no ESIC contribution is deducted for the leave period. Maintain proper records of the ESI maternity claim and the corresponding leave period.

Can employees opt out of ESIC?

No. ESIC is mandatory for all employees of covered establishments earning up to ₹21,000 per month. Neither the employer nor the employee can opt out of the scheme for eligible employees.

What benefits do employees get under ESIC?

ESIC provides: medical benefit (free treatment at ESIC hospitals and dispensaries for the employee and family), sickness benefit (cash payment of approximately 70% of wages for up to 91 days per year during certified sickness), maternity benefit (full wages for 26 weeks for female employees), disablement benefit (for work-related injuries), and dependent benefit (pension to family members on employee's death due to employment injury).
