Minimum Employees for ESIC (2026): Applicability, Who Counts and What Happens Next

The ESIC threshold is 10 employees — but who counts, which establishments are covered, and what happens if headcount drops? ESIC applicability explained, with a worked example.
"How many employees are needed for ESIC?" is one of the first compliance questions a growing Indian business runs into. The short answer is 10 — but that number comes with conditions: which employees count, which kinds of establishments are covered, whether ESI is implemented in your area, and what happens if your headcount later drops.
This guide explains ESIC applicability for establishments in 2026: the minimum number of employees, who counts, which businesses are covered, what happens once you're covered, and the mistakes that lead to back-dated demands.
General guidance as of 30 September 2026, not legal advice. ESI coverage is notified area by area and by type of establishment — check your specific position with ESIC or your CA.
The short answer
- Minimum employees for ESIC: 10. Factories and notified establishments with 10 or more employees in an ESI-implemented area are covered. (A few states have historically used 20 for some types of establishments — check yours.)
- Count all employees, including casual, temporary and contract workers engaged through contractors, not just those earning under ₹21,000.
- Once covered, always covered — coverage continues even if headcount falls below 10 later.
- Employee-level eligibility is separate: employees earning up to ₹21,000 a month (₹25,000 for employees with disabilities) are covered.
- Register promptly after crossing the threshold; contributions are due from the date of coverage.
Which establishments are covered?
ESI applies to:
| Type | Coverage |
|---|---|
| Factories | Non-seasonal factories with 10 or more persons |
| Shops | Notified in most states |
| Hotels and restaurants | Notified in most states |
| Cinemas and preview theatres | Notified |
| Road motor transport undertakings | Notified |
| Newspaper establishments | Notified |
| Private educational institutions | Notified in most states |
| Private medical institutions | Notified in most states |
| Other notified establishments | As notified by the state or central government |
In practice, most commercial businesses with 10 or more employees in an implemented area are covered. The Code on Social Security also allows ESI to be extended to establishments with fewer employees where hazardous work is involved, and allows voluntary coverage.
Is ESI implemented in your area?
ESI is implemented district by district. It now covers most districts in India, including almost all urban and industrial areas. If your establishment is in an area where ESI isn't yet implemented, the obligation to contribute may not apply — check the current list on the ESIC website or with your CA.
Who counts towards the 10?
| Counts | Notes |
|---|---|
| Permanent employees | Yes |
| Probationers and trainees (other than apprentices under the Apprentices Act) | Generally yes |
| Casual and temporary workers | Yes |
| Contract workers engaged through a contractor | Yes, for the principal employer's coverage |
| Employees earning above ₹21,000 | Yes — they count for coverage, even though they don't contribute |
| Apprentices under the Apprentices Act | Generally excluded |
The common mistake: counting only employees earning under ₹21,000. Coverage of the establishment depends on the total number of employees; eligibility to contribute depends on each employee's wages.
Establishment coverage vs employee eligibility
| Question | Rule |
|---|---|
| Is my establishment covered? | 10+ employees (all kinds) in an implemented area, in a covered type of establishment |
| Is this employee covered? | Wages up to ₹21,000 a month (₹25,000 for employees with disabilities) |
| When is eligibility decided? | At the start of each contribution period (April–September, October–March); an employee who is covered stays covered until the end of that period, even if their wages rise |
| Low-wage employees | Employees earning up to ₹176 a day don't pay the employee share; the employer still pays |
For the wage limit and contribution-period rules in detail, see our ESIC wage ceiling guide.
What happens when you cross 10 employees
- Coverage starts from the date you employ 10 or more persons.
- Register as an employer on the ESIC portal and get your 17-digit code.
- Register eligible employees and get their IP (insurance) numbers.
- Deduct 0.75% of gross wages from eligible employees; contribute 3.25% as employer.
- File and pay monthly by the 15th of the following month.
- Keep records of wages, attendance and contributions.
Worked example
A clinic in Nagpur has 8 employees in May. In June, it hires a nurse (₹18,000) and a receptionist (₹14,000), and a visiting doctor is engaged at ₹60,000 a month on the payroll.
- Headcount in June: 11 — the clinic is now covered.
- Eligible employees: everyone earning up to ₹21,000 — say 8 of the 11.
- Not eligible: the doctor and two senior staff above ₹21,000, but they still count towards the 10.
- Contributions for the nurse: employee ₹135 (0.75% of ₹18,000); employer ₹585 (3.25%).
- If headcount drops to 9 in December: the clinic remains covered.
Common mistakes
- Counting only low-wage employees towards the threshold.
- Ignoring contract workers.
- Waiting to register until an inspection.
- De-registering when headcount drops below 10 — coverage continues.
- Re-checking employee eligibility every month instead of per contribution period.
- Not registering new joiners promptly, so they can't access medical benefits.
How PeopleVio handles ESI after you're covered
PeopleVio's ESIC module handles the monthly work:
- Eligibility by contribution period, not month by month.
- The ₹21,000 ceiling (₹25,000 for employees with disabilities) and the ₹176 daily-wage exemption.
- Employee and employer shares calculated on gross wages earned, shown on payslips.
- The ESIC monthly contribution return as the portal's .xls file.
- Challan tracking and reminders before the 15th.
- Bulk import of ESIC IP numbers from Excel.
It doesn't register your establishment or generate IP numbers — you do that on the ESIC portal.
| Active employees | Monthly billing | Yearly billing (per month) |
|---|---|---|
| 10 | ₹590 | ₹490 |
| 25 | ₹1,475 | ₹1,225 |
| 50 | ₹2,450 | ₹2,050 |
Prices exclude GST; ESI, PF, payroll and attendance included. See the pricing page.
