Probation Period Rules in India (2026): Extension, Termination and Confirmation Letter

How long probation should be, what probationers are entitled to, extending and ending probation properly, and sample extension and confirmation letters.
Almost every Indian appointment letter has a probation clause — "you will be on probation for six months" — but few companies have thought through what it actually means. Is there a legal maximum? Can you extend it? Is a probationer entitled to PF, ESI and leave? Can you let someone go on the last day of probation without notice? And what happens if you simply forget to confirm them?
This guide explains probation period rules in India for 2026: how long probation should be, what probationers are entitled to, extension, termination during probation, confirmation, a probation clause and confirmation letter you can adapt, and the mistakes that turn probation into a dispute.
General guidance as of 2 October 2026, not legal advice. Standing orders, state Shops and Establishments Acts and your own contracts all affect probation. Check your position with a labour consultant.
The short answer
- There's no single law fixing probation for all employees. It's set by the appointment letter, the company's standing orders (if applicable) and policy.
- Typical probation: 3 to 6 months, sometimes extendable once by up to 3 months.
- Probationers are employees. PF, ESI, minimum wages, maternity benefit, statutory bonus eligibility and most leave rules apply from day one; service during probation counts towards gratuity.
- Notice during probation is usually shorter — 0 to 15 days — and must be in the contract.
- Extension must be in writing, before probation ends, with reasons.
- Confirmation should be issued in writing. Whether an employee is "deemed confirmed" without a letter depends on the contract and standing orders — don't rely on silence.
How long should probation be?
| Role | Typical probation |
|---|---|
| Workers, operators, frontline staff | 1–3 months (or as per standing orders) |
| Junior office roles | 3 months |
| Mid-level roles | 3–6 months |
| Senior and leadership roles | 6 months |
Standing orders for workers in industrial establishments have traditionally set relatively short probation periods. If your establishment is covered by standing orders (model or certified), those terms apply to workers regardless of what the appointment letter says.
Very long probation — a year or more for a junior role — invites challenge and hurts hiring. Keep it proportionate to how long it genuinely takes to assess someone in the role.
What probationers are entitled to
A probationer is an employee in every legal sense:
| Entitlement | During probation? |
|---|---|
| Minimum wages and timely payment | Yes |
| PF and ESI (if applicable) | Yes, from the date of joining — see PF calculation and ESIC applicability |
| Weekly off, national and festival holidays | Yes |
| Earned leave accrual | As per the OSH Code / state Act and policy; many policies allow accrual but restrict availing until confirmation |
| Casual and sick leave | As per policy; often pro-rata |
| Optional / restricted holidays | Commonly restricted until confirmation, by policy |
| Maternity benefit | Yes, if the woman has worked 80 days in the 12 months before delivery |
| Statutory bonus | Yes, if eligible and worked at least 30 days in the year — see bonus calculation |
| Gratuity | Probation service counts towards continuous service |
| POSH protection | Yes |
Companies sometimes restrict discretionary benefits — performance bonus, ESOPs, certain insurance top-ups, optional holidays — until confirmation. That's fine if it's in the policy and doesn't touch statutory entitlements.
Extending probation
Extension is common and generally acceptable if:
- The appointment letter or policy allows it — and states the maximum extension.
- It's done in writing before probation ends.
- It gives reasons and, ideally, specific areas to improve.
- It happens once, for a defined period (usually up to 3 months).
Repeated extensions or extensions after the probation date has passed are where disputes start. Some courts have treated employees as effectively confirmed when the employer let probation expire without action and the contract didn't say otherwise.
Sample extension letter
Subject: Extension of probation period
Dear [Employee name],
Your probation period, which began on [joining date], is due to end on [date]. Following your review on [review date], we have decided to extend your probation by [3] months, until [new date], as provided in clause [X] of your appointment letter.
During this period, we would like to see improvement in: [specific areas]. Your manager, [name], will review progress with you on [dates].
All other terms of your employment remain unchanged.

Ending employment during probation
Probation exists so both sides can assess fit — but termination during probation still needs to be done properly.
- Follow the contract's notice. If the appointment letter says 15 days' notice during probation, give 15 days or pay in lieu. If it says no notice, check the state Shops and Establishments Act — some require notice after a minimum period of service.
- Have a reason and a record. Performance reviews, feedback and warnings make the decision defensible. A probationer can still claim unfair treatment, discrimination or victimisation.
- Retrenchment rules for workers under the Industrial Relations Code generally apply after one year of continuous service, so most probation terminations fall outside them — but check for workers under standing orders.
- Misconduct during probation is a separate matter; follow your disciplinary process.
- Pay the F&F — salary to the last day and any dues — within 2 working days. See our F&F guide.
- Issue a service certificate — see our relieving and experience letter formats.
Resignation during probation follows the probation notice in the contract. See notice period rules.
Confirmation
At the end of probation, one of three things should happen — in writing:
- Confirmation, with any change in notice period, benefits or salary.
- Extension, with reasons (above).
- Termination, with notice as per the contract.
Sample confirmation letter
Subject: Confirmation of employment
Dear [Employee name],
We are pleased to inform you that, following a review of your performance during your probation period, your employment as [Designation] is confirmed with effect from [date].
From this date, the notice period for either party will be [60] days, and you will be eligible for [benefits applicable to confirmed employees — e.g. optional holidays, group health top-up, performance bonus].
All other terms of your appointment letter remain unchanged.
We look forward to your continued contribution.

Running a probation review
A simple review process makes decisions fair and fast:
- At joining: share role expectations and how they'll be assessed.
- Mid-probation (month 1–3): a check-in with the manager, with written feedback.
- Two weeks before the end date: formal review — strengths, gaps, recommendation (confirm, extend or end).
- Before the end date: HR issues the letter.
- File everything in the employee's record.
Reminders matter more than forms. Most probation problems happen because nobody noticed the date.
Sample probation clause for an appointment letter
Probation. You will be on probation for a period of [6] months from your date of joining. The company may extend the probation period once, by up to [3] months, by written notice before the end of the probation period, stating the reasons. During probation, either party may terminate employment by giving [15] days' written notice or salary in lieu of notice. On successful completion of probation, your confirmation will be communicated in writing, and the notice period will thereafter be [60] days. Statutory benefits apply from your date of joining. [Optional holidays / performance bonus / other discretionary benefits] apply from the date of confirmation.
See our appointment letter format for the full letter.
Worked examples
Example 1: confirming on time
Karan joins on 1 June with six months' probation, ending 30 November. His manager does a mid-probation check-in in August and a formal review on 14 November, recommending confirmation. HR issues the confirmation letter on 25 November, effective 1 December. From 1 December, his notice period moves from 15 days to 60 days, and he becomes eligible for optional holidays and the performance bonus plan.
Example 2: extending probation
Pooja joins on 1 April with three months' probation, ending 30 June. Her review on 20 June finds gaps in two specific areas. On 25 June — before the end date — HR issues an extension letter for three months, to 30 September, listing the two areas and fortnightly check-ins. On 22 September, she's confirmed.
If HR had issued the extension on 10 July, after probation had ended, Pooja could argue that she had already completed probation and the extension was invalid.
Example 3: ending employment during probation
Rahul joins on 1 August with six months' probation and 15 days' notice during probation. After two documented reviews with no improvement, the company decides to end his employment on 15 November. It gives 15 days' notice, with a last working day of 30 November. His F&F — salary to 30 November and any leave encashment due under policy — is paid by 2 December, and he receives a service certificate.
Example 4: probation and optional holidays
Neha joins on 1 October. The company's probation period is 90 days, and the company has an optional holiday on 10 November. Because she's still on probation on that date, the optional holiday doesn't apply to her, and it's a working day. National and festival holidays — and her weekly offs — still apply in full.
Probation for different types of employees
- Fixed-term employees. A short probation within a fixed-term contract is possible, but a long probation in a short contract makes little sense. Fixed-term employees get the same wages and benefits as permanent employees doing similar work.
- Internal transfers and promotions. Some companies apply a short "trial period" in a new role. Make clear that failing it means returning to the previous role, not termination.
- Rehires. Employees rejoining within a short period are often exempted from probation.
- Senior hires. Leadership roles may carry six months' probation with a longer notice period even during probation, to protect continuity.
Common mistakes
- No probation end date tracking — employees drift past probation with no decision.
- Extensions after the fact, or repeated extensions.
- Withholding statutory benefits (PF, ESI, minimum wages) during probation.
- "No notice" during probation without checking the state Act.
- No documentation of performance concerns before termination.
- Different probation for similar roles without reason.
- Confirmation by email only from a manager, not by an authorised signatory.
- Not updating the notice period after confirmation.
How PeopleVio helps
What PeopleVio does:
- Joining dates on every employee record, along with designation, department and documents.
- A company-wide probation period (in days) in settings. During probation, optional holidays don't apply to the employee automatically; national and festival holidays and weekly offs are unaffected.
- Offer letters with salary breakup and your own terms and conditions — including your probation clause — generated as a PDF and accepted by the candidate online with an email OTP.
- Onboarding checklists to make sure documents, PF/ESI details and policies are completed in the first weeks.
- Performance reviews and goals, so probation feedback is recorded rather than remembered.
- PF and ESI from day one through payroll, so probationers are covered correctly.
- Document storage for confirmation and extension letters on the employee profile.
What PeopleVio doesn't do (yet): it doesn't send probation-end reminders, track extensions or generate confirmation letters. Use the joining date and your probation period to schedule reviews, and upload signed letters to the employee's documents.
| Active employees | Monthly billing | Yearly billing (per month) |

Frequently asked questions
What is the maximum probation period in India? There's no single legal maximum for all employees. Three to six months is typical, with one extension of up to three months. For workers under standing orders, the standing orders apply.
Can probation be extended? Yes, if the appointment letter or policy allows it, and it's done in writing before probation ends, with reasons.
Is PF applicable during probation? Yes. PF and ESI (where applicable) apply from the date of joining, not from confirmation.
Is a notice period required during probation? As per the appointment letter. Many companies use 0–15 days. Check your state Shops and Establishments Act for any minimum.
Does probation count for gratuity? Yes. Service during probation counts towards continuous service for gratuity.
What happens if the employer doesn't confirm after probation? It depends on the contract and standing orders. Some courts have treated employees as effectively confirmed when probation lapsed without action. Always issue a written decision.
Can a probationer take leave? Yes, as per the OSH Code, the state Act and your policy. Many policies allow casual and sick leave during probation but restrict earned leave until confirmation.
Does PeopleVio track probation? PeopleVio stores joining dates and a company probation period, and applies probation rules to optional holidays. It doesn't yet send probation-end reminders or generate confirmation letters.
The bottom line
Probation is a short, defined period to assess fit — not a period without rights. Set a proportionate length, keep statutory benefits from day one, review before the end date and put every decision — confirm, extend or end — in writing.
Losing track of probation dates in a spreadsheet? PeopleVio keeps joining dates, offer letters, onboarding, reviews and payroll in one place, so every new hire starts right. See PeopleVio's pricing or book a demo.
